2. Description of the Service
2.1 Overview
The Fellowship of Beer LTD (hereinafter referred to as “the Company,” “we,” “us,” or “our”) operates a beer subscription service through which Members (hereinafter “you” or “your”) receive a curated selection of craft beers delivered periodically throughout the year. Our goal is to provide high-quality products and a community-focused experience centred around craft beer appreciation, education, and exclusive offerings.
2.2 Membership Benefits
By subscribing to The Fellowship of Beer, you gain access to the following benefits (collectively, the “Service”):
- Regular Beer Deliveries: You will receive six (6) shipments of curated beers per year, pro-rated according to your date of joining. Each shipment may contain a varying number of bottles or cans, along with tasting notes or additional resources.
- Community Access: You may be granted access to members-only events, online forums, or other exclusive content (where applicable).
- Special Offers: From time to time, the Company may provide discounts, promotional items, or other perks exclusively available to active Members.
2.3 Pro-Rata Shipments
If you join part-way through a calendar year or subscription cycle, the total number of shipments for that cycle may be adjusted accordingly. Your first shipment date will be communicated once registration and payment are confirmed. Subsequent shipments follow a schedule determined by the Company and may be subject to change.
2.4 Availability of Products
All beers and related products are subject to availability. While we strive to source and deliver a diverse range of high-quality craft beers, certain items may become unavailable due to seasonal changes, high demand, or supplier issues. We reserve the right to replace any unavailable product with a comparable alternative without prior notice.
2.5 Geographic Restrictions
At present, the Service is limited to Mainland UK deliveries. We reserve the right to modify eligible delivery regions at any time. If your address falls outside our current delivery area, we may decline your order and promptly refund any payments you have made.
2.6 Member Responsibilities
By subscribing to the Service, you acknowledge and agree that:
- You are of legal drinking age in your jurisdiction (18 years old in the UK or such other legal age as applies in your territory).
- You will provide accurate and up-to-date contact and delivery information.
- You are responsible for ensuring a person of legal drinking age is available to receive deliveries, if required by law or by the courier.
2.7 Changes to the Service
We reserve the right to introduce new features, remove or amend existing features, or otherwise modify the scope of the Service at our sole discretion. Any significant changes will be communicated through email, website updates, or other appropriate channels.
3. Membership Tiers, Billing, and Payments
3.1 Membership Tiers
- Local Collection: Members choosing this tier collect their subscription boxes from our designated local pickup point (currently Steam Machine Brewing Company, Unit 26 Northfield Way, Newton Aycliffe, County Durham DL5 6UF). This tier is charged at £25 per month.
- National Shipping: Members choosing this tier have their boxes shipped to a designated address within Mainland UK. This tier is charged at £30 per month, inclusive of shipping costs.
3.2 Billing Cycle
3.2.1 Monthly Charges
- All Members are billed monthly. Billing commences on the date you successfully register and provide payment details (the “Billing Date”).
- Subsequent charges occur on or near the same calendar day each month.
3.2.2 Continuous Membership and Auto-Renewal
- Your Membership continues month-to-month unless and until you cancel.
- Each year consists of six (6) boxes. Once you have received the sixth box in the annual cycle, your Membership renews automatically for the following year unless you cancel before the next Billing Date.
- By subscribing, you authorise us to charge your chosen payment method monthly at the rate corresponding to your selected tier.
3.3 Pro-Rata and Catch-Up Payments
3.3.1 Pro-Rata Calculation
- Each box in the annual schedule corresponds to two (2) monthly payments. You must therefore make at least two successful monthly payments to qualify for each box.
- If you join mid-cycle, you continue making your monthly payments. Once you have accumulated two payments toward the next scheduled box, you become eligible to receive it.
3.3.2 Catch-Up Payments
- If you wish to receive any boxes that you would not otherwise be eligible for (e.g., you joined late), you may make catch-up payments.
- These payments are charged at the monthly rate for your tier, enabling you to expedite eligibility for current or upcoming boxes.
- The exact amount and schedule for catch-up payments are determined on a case-by-case basis and communicated to you before processing.
3.4 Payment Methods
- You must provide a valid payment method (e.g., credit or debit card) upon registration.
- By providing payment details, you authorise The Fellowship of Beer LTD to charge your payment method for the monthly subscription fee.
- It is your responsibility to ensure that your payment information is current and valid. If payment cannot be processed, we may suspend or cancel your Membership until the issue is resolved.
3.5 Cancellation
- You may cancel at any time by contacting us at hello@fellowshipofbeer.org or through your online account (if available).
- Cancellations take effect at the end of your current billing cycle. You will continue to receive any boxes for which you have already qualified but will not be charged for future cycles.
- If you cancel before making two payments toward the next box, you forfeit eligibility for that box.
3.6 Changes to Membership Tiers and Fees
- We reserve the right to change Membership tier prices or introduce new tiers at our discretion.
- Price changes will be communicated at least thirty (30) days before going into effect. If you do not agree to the revised price, you may cancel your Membership before the new rate applies.
4. Pricing and Payment
4.1 Subscription Fees
- The current fees for each Membership tier (Local Collection or National Shipping) are specified in Section 3.1.
- All fees include any applicable taxes unless stated otherwise.
4.2 Late or Failed Payments
- If your payment method is declined or fails for any reason, we will notify you to update your payment information.
- Failure to resolve payment within a reasonable time may lead to suspension or cancellation of your Membership.
4.3 Additional Charges
- Shipping costs are included in the National Shipping tier.
- Any other fees (e.g., special delivery requirements or international shipping, if introduced) will be disclosed before you finalise your order or Membership.
5. Returns, Refunds, Damaged Goods, and Cancellations
5.1 Returns and Non-Returnable Items
- General Policy: Due to the perishable nature of alcoholic beverages, The Fellowship of Beer LTD does not generally accept returns if you simply change your mind or no longer want the items once shipped or collected.
- Non-Returnable Items: Opened, partially consumed, or tampered products cannot be returned under any circumstances.
- Exceptions: If you believe you have received a product in error or an incorrect box, please contact us within seven (7) days of receipt at hello@fellowshipofbeer.org. We will review and determine an appropriate resolution.
5.2 Damaged, Missing, or Incorrect Items
- Damage in Transit: If items arrive damaged, notify us within forty-eight (48) hours of receipt. We may request photos for verification before approving a replacement or refund.
- Missing Items: If any items are missing from your shipment, contact us promptly. We will investigate and arrange a replacement if warranted.
- Incorrect Products: If you receive a product that differs from what was described in your order or subscription details, we will send the correct items or provide an alternative solution at our discretion.
5.3 Refunds
- Eligibility: Refunds may be issued for damaged, missing, or incorrect products where we are at fault. We reserve the right to determine whether a replacement, partial refund, or full refund is appropriate.
- Refund Method: Approved refunds are issued to the original payment method unless otherwise agreed. Processing times depend on your bank or payment provider.
- Exclusions: Refunds are not provided for dissatisfaction due to taste preferences or issues stemming from improper storage or handling by the Member after delivery.
5.4 Cooling-Off Period
- If consumer protection laws in your jurisdiction mandate a cooling-off period (e.g., 14 days under UK law for distance selling), we will honour it in compliance with applicable regulations. Please note that for perishable goods like beer, exceptions may apply, limiting or excluding standard cooling-off rights.
5.5 Your Statutory Rights
Nothing in these Terms & Conditions is intended to limit or exclude your statutory rights under applicable law, including the Consumer Rights Act 2015 (or equivalent legislation).
